If you are located in the EU or UK, this section applies to you.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

• For identifying injured, ill, or deceased persons and communicating with next of kin

• If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse

• If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province

• If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records

• If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced

We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising, including to help manage and display advertisements, to tailor advertisements to your interests, or to send abandoned shopping cart reminders (depending on your communication preferences). The third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear either on our Services or on other websites.

To the extent these online tracking technologies are deemed to be a 'sale'/'sharing' (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies by submitting a request as described below under section 'DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?'

7. CAIDEL FOR WOOCOMMERCE

In Short: When a shop uses our WooCommerce plugin, we hold the shop owner's account details as a controller, and we process the shop's catalogue and its shoppers' questions on the shop's behalf, as a processor. We never receive shoppers' names, email addresses, customer records or IP addresses, and the plugin sets no cookies.

What we hold about the shop and its owner (we are the controller). When a shop connects: the shop's web address, its site name, the WordPress admin email address, the name of the person who connected it, and the plugin, WordPress, WooCommerce and PHP versions. When the shop asks for support: the message, the name and email address given, and, unless unticked, diagnostic details about the shop's setup. We use these to run the shop's account and trial, to support it, and to contact the shop about the service.

What we process for the shop (we are the processor).

• Shop content: products, prices, stock, categories, pages, policies and product reviews, including the display name a reviewer chose to publish with their review. We use it to answer the shop's search and assistant questions.
• Questions and what came of them: what shoppers and AI shopping agents type into the shop's search or assistant, and, if the shop switches on "Send to CAIDEL", which products were shown, clicked, added to the basket and ordered, with the value of those order lines. Where a conversation carries an identifier, we keep only a salted hash of it, so that the turns of one conversation can be grouped without identifying anyone.
• The AI Operator: if the shop switches it on, an access key for the shop (stored encrypted) and a log of the changes it proposed and the shop approved.

Improving CAIDEL. Phrases shoppers use, grouped by meaning, are added to a shared vocabulary that helps CAIDEL understand the words shoppers use in a product category. What we keep there has no shop, product or person attached to it, and it cannot be traced back to the shop that contributed it.

Where. The service and its database run on Microsoft Azure in the Sweden Central region (EU). Answers written by AI are generated by Microsoft Azure OpenAI, within the EU data zone. Shoppers' browsers never contact CAIDEL; the shop's own server does.

How long. While the shop is connected. "Disconnect and erase" in the plugin, and deleting the plugin, delete the shop's content, questions, measurements, Operator data and vocabulary at once. We keep afterwards: the shop owner's account, subscription and usage records, which we need for billing and accounting; the shop's web address and trial dates, so a domain receives one free trial; support tickets, as a record of the help we gave; and the shared vocabulary, which holds nothing that identifies the shop. Deleted data leaves our backups within 14 days, and our service logs within 30.

The shop's own notice. A shop using CAIDEL is the controller for its shoppers' data and should say in its own privacy notice that it uses CAIDEL to answer search and assistant questions.

8. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.

Our Services offer you the ability to register and log in using your third-party social media account details (like your Facebook or X logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such a social media platform.

We will use the information we receive only for the purposes that are described in this Privacy Notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.

9. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfil the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than twelve (12) months past the termination of the user's account.

For CAIDEL for WooCommerce, the retention described in 'CAIDEL for WooCommerce' applies.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

10. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organisational and technical security measures.

We have implemented appropriate and reasonable technical and organisational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorised third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. If you become aware of any data we may have collected from children under age 18 or the equivalent age as specified by law in your jurisdiction, please contact us at info@caidel.com.

12. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on your state of residence in the US or in some regions, such as the European Economic Area (EEA), United Kingdom (UK), Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information. You can withdraw your consent at any time by contacting us by using the contact details provided in the section 'HOW CAN YOU CONTACT US ABOUT THIS NOTICE?' below or updating your preferences.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

13. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ('DNT') feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognising or honouring DNT signals, we do not respond to them at this time.
